A 34-year-old man went to the Emergency Room at Rush Copley Medical Center in Aurora with severe pain in his left arm, a fever and chills. The patient was incorrectly diagnosed with a superficial skin infection when he had a limb-threatening, flesh-eating infection. The patient was admitted for monitoring and given antibiotics. Overnight, the infection progressed up his arm until the Rush-Copley doctors finally took him to surgery. The delay in treatment resulted in the patient’s arm being amputated below the shoulder. Cook County jury awarded over $10 million in damages, including interest in October 2023.

$5 Million Settlement for Brain Injury From Gastric Bypass Surgery

We were lead counsel representing the guardian of a 47-year-old woman who developed extensive bleeding and clotting and digestive tract trauma following gastric bypass surgery. One of the two original surgeons removed the blood clots in a follow-up procedure. When problems reappeared, a second follow-up procedure was needed, and the patient remained in intensive care for four weeks — after which she suffered acute kidney dysfunction, hyperkalemia and cardiac arrest. The result was a brain injury and significant weakness in both legs that rendered her wheelchair-bound. After the deposition of our experts in the case, the hospital agreed to a $5 million settlement approved by Cook County Court, although the case against the surgeons is still pending.
